1. Plain-English summary

SafeSKU is a classifier and monitoring service for California Proposition 65 warning requirements. We screen your product ingredients against OEHHA's Prop 65 chemical list + published case-law exemptions, and we email you when OEHHA adds or removes a chemical that affects your catalog.

We are not a law firm. We don't give legal advice. Our results are informational, not a binding compliance determination. Where the stakes are high — large catalog, lawsuit risk, settlement under negotiation — consult an attorney.

2. What you're paying for

Subscription tiers (Monitor, Assured) entitle you to use the features listed on our pricing page at the SKU caps published there. We may add features within your tier without notice; we'll give you at least 30 days' notice before removing or materially changing one.

Pricing displayed at signup is what you pay until you cancel or we notify you in writing at least 30 days in advance of a change.

3. Your data

Your catalog (SKU names, ingredient lists, categories) is stored so we can re-audit it against OEHHA changes. We don't sell it, share it with marketers, or train models on it.

If you cancel, we retain your data for 30 days (so you can resubscribe and pick up where you left off), then purge it. You can request immediate deletion by emailing support.

4. No guarantees

Our classifier is good (zero false positives on a 100-SKU benchmark across cosmetics, supplements, candles, apparel, home goods) but it is not infallible. We do not guarantee that following our output will prevent a Prop 65 60-day notice or settlement. Final responsibility for compliance rests with you.

We're not liable for direct or consequential damages arising from your use of the service beyond the amount you paid us in the prior 12 months. Where law doesn't allow such a cap (e.g. for gross negligence), liability is limited to the minimum allowable by law.

5. Acceptable use

Don't reverse-engineer the service to build a competing classifier. Don't scrape our API outside the rate limits of your tier. Don't upload someone else's catalog without their authorization.

6. Termination

You can cancel anytime from the Manage Billing portal in your dashboard. We can terminate your subscription for non-payment, for violation of the acceptable-use clause, or if the service shuts down — in which case we'll refund any prepaid unused portion.

7. Governing law

These terms are governed by the laws of the State of California. Disputes go to the state or federal courts located in San Francisco County, California.
